Welcome to characteradvantage.org (the “Site”), operated by Sports Serve, LLC (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

Refund requests must be submitted within 30 days of purchase by contacting info@characteradvantage.org. Refund eligibility is determined at our discretion based on the nature of the product and usage.

You must not access or use for any commercial purposes any part of the Site or any services or materials through the Site. If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Site in breach of the Terms, your right to use the Site will stop immediately, and you must, at our option, return or destroy any copies of the materials you have made. "CHARACTER advantage," "Parents Compass Playbook," "Compass Circle," "Compass Check," "Compass Circle Community", and "Skill × Character = Capacity" are trademarks or service marks of Sports Serve, LLC. You may not reproduce, distribute, modify, or create derivative works from any content or materials from this Site without our prior written permission.

6. User Conduct

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
→ In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
→ To reproduce, share, or distribute paid content (courses, playbooks, coaching materials) without authorization.
→ Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site, including their ability to engage in real-time activities through the Site.
→ Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

→ Use any manual process to monitor or copy any of the material on the Site, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
→ Use automated tools (bots, scrapers) to collect data from the Site.

→ Otherwise attempt to interfere with the proper working of the Site.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Limitation of Liability

To the fullest extent pROVIDED by applicable law, Sports Serve Inc., its officers, directors, employees, and agents shall not be liable for ANY DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING any indirect, incidental, special, consequential, or punitive damages, including but not limited to, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, loss of profits, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF DATA, LOSS OF GOODWILL, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE .

The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless Sports Serve, LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

10. Governing Law

All matters relating to the Site and these Terms, and any disputes or claims arising under or related to these Terms, shall be governed by and constructed in accordance with the laws of the State of Georgia without giving effect to any choice of law provision or rule (whether of the State of Georgia or any other jurisdiction).

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Georgia. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Waiver and Severability

No waiver by Sports Serve, LLC of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Sports Serve, LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12. Entire Agreement

The Terms and our Privacy Policy constitute the sole and entire agreement between you and Sports Serve, LLC regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
